Agreement to Terms

By scheduling an appointment, accessing our website, or using our services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services.

Services Provided

Kreative Healing Psychiatry provides psychiatric mental health services including:

  • Psychiatric evaluations and assessments
  • Medication management
  • Individual therapy
  • Treatment planning and monitoring
  • Telehealth services

Our services are provided by Kerry Callender, PMHNP-BC, a board-certified Psychiatric Mental Health Nurse Practitioner licensed in New York.

Patient Responsibilities

Accurate Information

You agree to provide accurate, current, and complete information about yourself, including medical history, current medications, and insurance information. You must update us promptly of any changes to this information.

Appointment Attendance

You are responsible for attending scheduled appointments on time. If you cannot attend an appointment, you must provide at least 24 hours notice of cancellation.

Treatment Compliance

You agree to actively participate in your treatment plan and follow the recommendations provided by your psychiatric provider to the best of your ability.

Communication

You agree to communicate openly and honestly with your provider about your symptoms, concerns, and any side effects from medications.

Appointment Scheduling and Cancellation

Scheduling

Appointments can be scheduled by phone at (917) 540-2360 or through our online booking system. We will make reasonable efforts to accommodate your preferred appointment times.

Cancellation Policy

We require at least 24 hours advance notice for cancellations or rescheduling. Late cancellations (less than 24 hours notice) or no-shows may result in a cancellation fee equivalent to the full session cost. This fee is not covered by insurance.

Provider Cancellations

We will make every effort to notify you as soon as possible if we need to cancel or reschedule your appointment. No fees will be charged for provider-initiated cancellations.

Fees and Payment

Professional Fees

Our fees vary by service type and session length. Fees will be clearly communicated to you before your first appointment.

Insurance

We accept most major commercial insurance plans including Aetna and Anthem Blue Cross and Blue Shield of Massachusetts. It is your responsibility to verify your coverage and benefits before your appointment. Any charges not covered by insurance are your responsibility.

Payment Methods

We accept payment by credit card, debit card, and HSA/FSA cards. Payment is due at the time of service.

Sliding Scale

For patients paying out-of-pocket, a sliding scale fee may be available based on financial need. Please contact us to discuss options.

Telehealth Services

Consent for Telehealth

By participating in telehealth services, you consent to receiving psychiatric care via secure video conferencing. You understand that telehealth involves electronic communication of your personal medical information.

Technology Requirements

You are responsible for ensuring you have:

  • A reliable internet connection
  • A device with camera and microphone capabilities
  • A private, quiet location for your appointment
  • The necessary software or app for video conferencing

Limitations of Telehealth

You understand that telehealth has limitations including potential for technical difficulties, limitations in physical examination, and risks to privacy if your location is not secure.

Emergencies and Crisis Situations

Our practice is not equipped to handle psychiatric emergencies. If you are experiencing a mental health emergency or crisis, you should:

  • Call 911 or go to your nearest emergency room
  • Call the National Suicide Prevention Lifeline: 988
  • Call the Crisis Text Line: Text HOME to 741741

Email and voicemail are not monitored 24/7 and should not be used for urgent matters.

Confidentiality and Privacy

We are committed to protecting your privacy in accordance with HIPAA regulations. Please review our Privacy Policy for detailed information about how we collect, use, and protect your health information.

Exceptions to Confidentiality

Your information may be disclosed without your consent in the following situations:

  • You pose an imminent danger to yourself or others
  • There is suspected abuse or neglect of a child, elderly person, or disabled person
  • A court orders the release of information
  • You are involved in legal proceedings where your mental health is at issue
  • As otherwise required by law

Medical Records

You have the right to access your medical records. Requests for copies of records should be made in writing. A reasonable fee may be charged for copying and mailing records. We will respond to your request within the timeframe required by law.

Prescriptions and Medications

Medication Management

If medication is part of your treatment plan, you agree to:

  • Take medications as prescribed
  • Report any side effects or concerns promptly
  • Attend regular follow-up appointments for medication monitoring
  • Not share your medications with others
  • Properly store and dispose of medications

Prescription Refills

Prescription refill requests should be made during regular business hours with at least 48 hours notice. Refills will generally not be provided if you are significantly overdue for a follow-up appointment.

Controlled Substances

If you are prescribed controlled substances, you may be required to:

  • Sign a controlled substance agreement
  • Use only one pharmacy
  • Submit to random drug screenings
  • Attend more frequent follow-up appointments

Professional Boundaries

To maintain a therapeutic relationship, we maintain professional boundaries including:

  • No social media connections with current patients
  • No dual relationships (e.g., business, social, or family relationships)
  • All communication should occur through appropriate channels
  • Gift giving is discouraged to maintain objectivity

Termination of Services

Patient-Initiated

You have the right to discontinue treatment at any time. We recommend discussing your decision with your provider to ensure a safe transition of care.

Provider-Initiated

We reserve the right to terminate the therapeutic relationship if:

  • You repeatedly miss appointments without notice
  • You fail to comply with the treatment plan
  • Payment obligations are not met
  • You engage in threatening or abusive behavior
  • A conflict of interest arises
  • Treatment goals have been met

In such cases, we will provide you with referrals to other providers and a summary of your treatment.

Intellectual Property

All content on our website, including text, graphics, logos, and images, is the property of Kreative Healing Psychiatry and protected by copyright laws. You may not reproduce or distribute our content without written permission.

Limitation of Liability

To the fullest extent permitted by law, Kreative Healing Psychiatry and its providers shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services or website.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting on our website. Continued use of our services after changes constitutes acceptance of the modified terms.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.
